Terms of Service
Last Updated: October 29, 2026
1. Acceptance of Terms
By accessing or using the APIs, endpoints, software, or web services provided by Infergator AI ("Infergator", "we", "us", or "our"), including via OpenRouter or direct integration, you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.
2. Service Provision & Availability
Infergator provides high-performance model inference services powered by dedicated hardware clusters. While we strive to maintain 99.99% service availability:
- Services are provided on an "as is" and "as available" basis.
- We may perform scheduled hardware maintenance, driver updates, or cluster balancing with minimal disruption.
- Rate limits may be applied dynamically to safeguard infrastructure against malicious denial-of-service attempts.
3. Acceptable Use Policy
You agree not to use the inference API to:
- Generate, facilitate, or distribute illegal content, non-consensual imagery, or child sexual abuse material (CSAM).
- Conduct cyberattacks, automated vulnerability exploitation, or malware synthesis targeting critical infrastructure.
- Attempt to reverse-engineer, decompile, or compromise the underlying host systems or edge gateways.
- Circumvent rate limits, quotas, or billing reconciliation mechanisms.
4. Billing & Marketplace Routing
For queries routed through the OpenRouter marketplace, token pricing, payments, refunds, and usage metering are governed by OpenRouter's merchant terms. Token counts reported in inference streaming chunks (usage object) represent official billing tallies calculated according to standard BPE tokenizer specifications.
5. Intellectual Property & Outputs
Infergator AI claims no ownership or intellectual property rights over the prompts submitted or the model outputs generated by your requests. All rights to customer inputs and resulting outputs remain solely with you or the respective upstream model weight license holders.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Infergator AI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues resulting from the use of or inability to use the inference service.
